Applicant: Madison Planning & Zoning Commission. Proposal for the Town of Madison to “opt-out” of Connecticut Public Act 17-155, the State legislation allowing for Temporary Health Care Structures in single-family residential zones. The purpose of the hearing is to solicit public comment on the proposal pursuant to the subject Act. Unless the Town “opts-out”, the subject Act requires the issuance of permits for Temporary Health Care Structures as accessory uses that conform to standards set forth in the Act. A Temporary Health Care Structure is defined by the Act as a transportable residential structure, not larger than 500 gross square feet, primarily assembled off-site, that is owned by a caregiver or mentally or physically impaired person and used as his or her residence. The temporary structure must comply with applicable provisions of the State Building Code, Fire Safety Code, and Public Health Code. The Town may require the structure to conform to applicable zoning setbacks, building coverage, and floor area standards, and may require that such structures establish connections with septic systems and/or water, sewer and electric utilities, and be accessible to emergency vehicles.
